Axle Energy respects your privacy and is commited to protecting your personal data. This privacy policy will inform you as to how we look after your personal data and tell you about your privacy rights and how the law protects you. Please read this privacy policy carefully.

1. Important information and who we are

About us

Axle Energy Limited is registered in England under company number 14633671 (“Axle Energy”, “we”, “us”, or “our”). We provide software that allow us to control home energy devices to shift energy consumption to cheaper and greener periods within the constraints of the grid and your personal preferences (our “Service”) to home energy asset owners, manufacturers, service providers and end-users (collectively known as “Users”, “you” or “your”). We process information on home energy behaviour. We use this information to provide services and enable home energy device monitoring to end-users and related service providers, such as energy suppliers.

Purpose of this privacy policy

This privacy policy aims to give you information on how Axle Energy and our partners collect and process your personal data through your use of a mobile application, website, platform, API, and/or mobile application (collectively, the “Software”), including any data you may provide for and during our Service.

Our Software is not intended for children and we do not knowingly collect data relating to children.

It is important that you read this privacy policy together with any other privacy policy or fair processing policy we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy policy supplements other notices and privacy policies and is not intended to override them.

Controller

Axle Energy is the controller and responsible for your personal data. This means that we determine the purposes for which, and the manner in which, your data is processed.

Changes to the privacy policy and your duty to inform us of changes

We keep our privacy policy under regular review. It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

Third-party links

This Service may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their practices, content, or privacy statements. When you leave our website, we encourage you to read the privacy policy of every website you visit.

2. The data we collect about you

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). The personal information that we collect enables us to:

  • a) deliver and improve the Service;
  • b) support you to use the Service; and
  • c) work with your energy company, OEM, TSO, DSO or other relevant party to deliver the Service.

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity and Contact Data about you and how to contact you. This may include:
    • First name and last name
    • Your username or similar identifier
    • An encrypted version of your password
    • Your social media username (if you interact with us via social media)
    • Your home address, e-mail address(es) and telephone number(s)

  • Profile and Consent Data which comprises preferences (for marketing and other notifications), feedback and survey responses you have provided and partly anonymised analytical information about how you use our app. This may include:
    • Your preferences on how and when we can contact you
    • Preferences on your subscriptions to digital marketing and non-marketing communications
    • A record of where you have provided or withdrawn consent to share your data with third-parties
    • Feedback to surveys and questionnaires
    • Feedback provided during design research programmes
    • Partly anonymised data from app and website analytics platforms

  • Hardware Data about your home energy devices (e.g., EV, charger) so we know when to control the device. This may include:
    • The make, model, trim, registration or licence and VIN of your vehicle
    • The battery size and charging capabilities of your devices
    • The make, model and configuration of your devices
    • The state of charge of your devices
    • The location of your devices
    • If your devices and charger are connected
    • If your devices are charging/powered on
    • If your device is in a manufacturer service mode
    • If your vehicle is stationary
    • Current and desired temperature
  • Energy Data such as your energy supplier, tariff and meter reference number so we can apply the right tariff and grid information to your supply, and so (with your consent) we can identify smart charging to third-parties. This may include:
    • Your energy supplier name and price plan or tariff name
    • Your home energy consumption and production
    • Billing information about your supply such as your energy supplier account number
    • MPAN or Meter Serial Number
  • Third-Party Account Data which allows us to link your axle energy account to your vehicle, charger or energy supplier accounts. This may include:
    • Encrypted username and password or access token for a third-party service kept in a secure enclave
    • Account identifiers or references to identify your account in a third-party’s system
    • These data will only be requested and stored after you have provided consent
  • Technical Data about the device you use to connect to our platform, your time zone and locale to enable us to tailor the user experience for your device and to ensure we support the devices you want to use to access the app and platform. This may include:
    • Connection information such as IP address
    • Device geolocation
    • Client information such as the type and version of the device, operating system, browser and any plugins you may be using
    • Your time zone and locale
  • Transaction and Financial Data about your energy usage and for any services you purchase through the platform. This may include:
    • Details of the products and services you have purchased from us
    • Details of how much energy used to charge your electric vehicle, and when this charging happened
    • Payment information made to us from you, including references to your account stored in our payment providers’ system
  • Tracking Data which includes information we or others collect about you from cookies and similar tracking technologies such as web beacons, pixels and mobile identifiers. This may include:
    • Includes information we or others collect about you from cookies, user attribution and similar tracking technologies in each case, in accordance with this privacy policy.

We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel the Service you have with us but we will notify you if this is the case at the time.

3. How is your personal data collected?

Before using the Service, we will ask for your consent to capture, process and share your information. We only collect the personal data required to enable us to deliver and support our Service to you.

We use different methods to collect data from and about you including through:

  • Direct interactions. You may give us your Identity, Contact and Financial Data by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:
    • apply for our services;
    • create an account on our website or mobile application;
    • register a home energy device on our website or mobile application;
    • subscribe to our service or publications;
    • request marketing to be sent to you;
    • enter a competition, promotion or survey; or
    • give us feedback or contact us.

  • Automated technologies or interactions. As you interact with our Software, we will automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, server logs and other similar technologies. We may also receive Technical Data about you if you visit other websites employing our cookies. Please see our cookie policy for further details.
  • Third parties or publicly available sources. We will receive personal data about you from various third parties as set out below:
    • Energy suppliers. You may hear about us from a third party, such as your energy supplier, and they may provide your contact details to us after asking for your consent. We will rely on this consent provided to the third party to tell you about our Services.
    • Technical Data from analytics providers, advertising networks, and search information providers.
    • Identity and Contact Data from data brokers or aggregators based inside the UK and Europe.
    • Contact, Financial and Transaction Data from providers of technical, payment and delivery services.

4. How we use your personal data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). You can obtain further information about how we assess our legitimate interests against any potential impact on you in respect of specific activities by contacting us.
  • Where we need to perform the contract we are about to enter into or have entered intow ith you.
  • Where we need to comply with a legal obligation.

We do not use your data for any automated decision-making or profiling.

Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. Marketing

We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising.

Promotional offers from us

We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you (we call this marketing).

You will receive marketing communications from us if you have requested information from us or subscribed to our Services from us and you have not opted out of receiving that marketing.

Third-party marketing

We will get your express opt-in consent before we share your personal data with any third party for marketing purposes.

Opting out

You can ask us or third parties to stop sending you marketing messages at any time by contacting us at any time.

Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a product/service purchase, product/service experience or other transactions.

Cookies

Cookies are small parts of data that are not used for identification purposes but that learn about your usage and browsing behaviour based on how you interact with our website.

You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. If you disable or refuse cookies, please note that some parts of the website may become inaccessible or not function properly. Change of purpose

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

5. Disclosure of your personal data

The information that we request will be used and retained by us and only shared with third parties where it is necessary to provide the service to you, and then only as described in this privacy policy.

All third-parties will undergo a due-diligence assessment and a written agreement with specific terms around data security and privacy is in place.

We may share your personal data with the reasons and parties set out below:

Providing our Service

Axle Energy uses selected third parties such as service providers, professional advisors, and authorities. We may share your personal information with them to allow us to provide and improve our Service.

We may share anonymised data with third parties such as energy companies and distribution system operators. The information transmitted is anonymised, which means no personal information about you is provided and location data is obfuscated to a larger area (such as a neighbourhood, or a position to within 100m to suitably ensure anonymity). Consequently, a third-party will not be able to identify you from any data shared directly from us.

Legal reasons

We may share personal data where we have a legal obligation to do so; for example when directed by a court, or if requested with an appropriate warrant by law enforcement or tax agencies. We may also share information without your permission where a person’s life is in danger and to instigate or defend a legal claim, for example, with a solicitor, our professional advisors, or a court.

Supporting our Users

If you require support from us, we may share your personal data with suppliers and subcontractors to help resolve this issue. The data will include the nature of the query and any data supporting that, which may include Identity and Contact Data, Technical Data, Hardware Data as defined in Section 3. We will only share the information where it is necessary to allow us to be able to provide those products and services to you.

Providing enhanced services and rewards

We may offer you enhanced services and rewards, which may be delivered in partnership with third-party providers.

To confirm eligibility for these services, we may share Energy Data and Contact Data about you with these third-party energy companies:

  • Electricity network companies, who deliver the electricity network in your local area;
  • Electricity market operators who help balance the grid on behalf of energy generators, network companies and consumers; and
  • Energy service providers who provide aggregation or access services to energy markets.

We may also share your email address and contact details to enable us to deliver an enhanced service and/or reward to you.

You can opt-out of any of these enhanced services at any time.

Business transfer

We may disclose your information to third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

Other reasons

We may share limited personal information with third parties if we determine, following an assessment, that the sharing is necessary in order to meet our legitimate interests, or promotes your interest and does not breach data protection laws.

We may also share your contact details with third parties for marketing purposes if you have given consent for this via your account or another method; and we may share your details with third parties if this is necessary to fulfil a contract with you.

There may be occasions when a third party who has not agreed to our terms of use or privacy policy will interact with our Software. It is the responsibility of the account holder on our Software to ensure that third-parties are made aware of the integration prior to interacting with the Service.

6. International transfers

Our external third parties are based across Europe so their processing of your personal data may involve a transfer of data between the countries.

This privacy policy is governed by the UK and EU GDPR but we ensure a similar degree ofprotection is afforded to the transfer of your personal data by ensuring at least one of the following safeguards is implemented:

  • We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data.
  • Where we use certain service providers, we may use specific contracts approved for use in the relevant country which give personal data the same protection it has in the UK and EU.

7. Data security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

We will take appropriate technical and organisational precautions to secure your personal data and to prevent the loss, misuse or alteration of your personal data.

To help protect your account and personal information, you should ensure that your password is not susceptible to being guessed, whether by a person or a computer program. You are responsible for keeping the password you use for accessing our Software confidential, and we will not ask you for your password (except when you log in to our platform).

We won’t ask you to share sensitive information, such as bank details, for the purpose of verifying your identity. If anyone purporting to be us does ask for sensitive information, then please contact us using the details provided below.

8. Data retention

How long will you use my personal data for?

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. Occasionally, there will be ad-hoc consideration to delete data we no longer require.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

Users can initiate account deletion, i.e. exercising their right to erasure, by contacting us. There may be circumstances in which we cannot delete some personal data where we have a legal requirement to retain it, such as participation in a Grid Support project. If you have any questions or want to know more about the data we are unable to delete, feel free to contact us using the details provided below.

In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

9. Your legal rights

Under certain circumstances, you have rights under data protection laws in relation to your personal data. You have the right to:

Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:

  • If you want us to establish the data's accuracy.
  • Where our use of the data is unlawful but you do not want us to erase it.
  • Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.
  • You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

No fee usually required

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond
We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

10. Job applicants’ privacy

Information we collect about you

In order to process your application, we ask you to provide certain personal data, also referred to as personally identifiable information (PII). The legal basis for processing your PII is by consent and therefore providing it is voluntary, however, some are required for us to properly consider your application. If you were not successful in your application, we will keep a copy of it for a period of 6 months from the closing date of the role you have applied for.

We may collect, store, and use the following categories of information about you during the application phase:

  • Personally Identifiable Information: We collect your personal contact details such as name, address, email address and telephone number. We also collect contact information for your references; it is your responsibility to obtain consent from your references before providing their personal information to us.
  • Sensitive Data: We ask you not to disclose any sensitive personal data during the application phase as we do not feel this required.
  • Internet or Other Electronic Network Activity Information: Our website uses cookies - see Section 5.

Application sub-processors

We may use third party service providers to assist with our application procedure and only share data where appropriate measures are in place to protect the security of your data.

11. User Research

We undertake regular user research in order to guide the development of our Service. The data collected will only be used for research purposes and never sold to third parties. We record the user interviews to enable post-review, however these are deleted as soon as they are no longer relevant or after a period of three years (whichever is soonest). If we transcribe your interview, then we will retain this following the expiry of three years, however we will anonymise all personally identifiable information. We will, at all times, keep research source materials secure.

Axle Energy procédera à la désignation d’un représentant dans l’Union européenne avant le démarrage effectif des traitements concernés en France/EEE. Les coordonnées du représentant seront publiées dans cette section dès sa désignation.

Notre Service n’est pas destiné aux enfants et nous ne collectons pas sciemment de données relatives à des mineurs. Si vous estimez qu’un mineur nous a transmis des données personnelles, merci de nous contacter afin que nous puissions prendre les mesures appropriées.

Notre Service peut contenir des liens vers des sites ou services tiers. Nous ne contrôlons pas ces tiers et ne sommes pas responsables de leurs pratiques en matière de protection des données. Nous vous invitons à consulter leurs politiques de confidentialité.

2. Catégories de Données Personnelles Traitées

Les données personnelles sont toutes les informations qui se rapportent à une personne identifiée ou identifiable. Conformément au RGPD, les données à caractère personnel désignant toute information relative à l’Utilisateur telle qu’un nom, un numéro d’identification, des données de localisation, un identifiant en ligne. Nous ne collectons pas volontairement de catégories particulières de données (santé, opinions politiques, etc.) ni de données relatives aux condamnations pénales. Nous ne collectons pas de données relatives à vos cartes de paiement et informations bancaires, la collecte et le traitement de ces données étant gérées par un prestataire de services de paiements tiers.

Les données traitées (ensemble, les « Données ») comprennent :

  • Identifiant / nom d’utilisateur
  • Mot de passe (stocké sous forme sécurisée et chiffrée)

2.2. Données de profil et de consentement

  • Préférences de contact (marketing, notifications)

  • Réponses à des enquêtes et retours utilisateurs
  • Données analytiques d’usage (dans la mesure du possible, pseudonymisées ou agrégées)

2.3. Données relatives aux équipements (« données matérielles »)

Selon les équipements connectés (ex. véhicule électrique, borne, batterie, onduleur, pompe à chaleur, thermostat, chauffe-eau) :

  • Marque, modèle, configuration
  • Capacités techniques (puissance de charge, capacité batterie, etc.)
  • État de charge et informations opérationnelles
  • Statut de connexion / alimentation
  • Température actuelle et souhaitée
  • Localisation de l’équipement lorsque nécessaire au Service

3. Objectif et bases juridiques de la collecte et du traitement des Données

Nous ne collectons que les Données nécessaires à la fourniture et au support du Service.

Les bases juridiques sur lesquelles reposent la collecte et le traitement des Données par Axle Energy sont les suivantes :

  • Consentement de l'Utilisateur : pour les Données fournies lors de la création du Compte, de son paramétrage ou de l'utilisation de la Plateforme ;
  • Intérêts légitimes : La collecte et le traitement de Données telles que les Données d'utilisation du processus sont nécessaires aux fins des intérêts légitimes poursuivis par Axle Energy ;
  • Exécution d'un contrat : la collecte et le traitement des Données sont nécessaires à l'exécution du contrat conclu avec l'Utilisateur et/ou des obligations précontractuelles qui en découlent ;
  • Obligations légales : La collecte et le traitement des Données sont nécessaires au respect d'une obligation légale à laquelle Axle Energy, ses partenaires ou ses sous-traitants sont soumis.

4. Sécurité et confidentialité des Données

Nous mettons en œuvre des mesures techniques et organisationnelles appropriées et conformes aux meilleures pratiques, notamment en ce qui concerne la sécurité de notre système d’information. Nous nous engageons à mettre en œuvre toutes les mesures appropriées pour préserver la confidentialité et la sécurité des Données et empêcher qu’elles ne soient altérées, endommagées, détruites ou que des tiers non-autorisés y aient accès. A cette fin, Axle Energy exige de ses sous-traitants qu’ils fournissent un degré de protection similaire à celui de Axle Energy.

L’accès aux données est limité aux personnes ayant un besoin légitime d’y accéder.

En cas de violation de données personnelles, nous notifierons l’autorité compétente et/ou les personnes concernées lorsque la loi l’exige.

Veuillez noter que même si nous faisons de notre mieux pour protéger les Données des Utilisateurs, Axle Energy ne peut pas garantir leur sécurité absolue.

5. Politique en matière de cookies et traceurs

Les cookies strictement nécessaires au fonctionnement du Service peuvent être utilisés sans consentement.

Les cookies et traceurs non essentiels (ex. mesure d’audience non exemptée, publicité personnalisée) sont utilisés uniquement après recueil de votre consentement lorsque requis.

Vous pouvez accepter ou refuser ces traceurs de manière simple et modifier vos choix à tout moment via notre module de gestion des cookies.

Votre choix (acceptation/refus) est conservé pendant une durée raisonnable, en principe six (6) mois, sauf circonstances particulières. Vous pouvez accéder à notre Politique Cookies en cliquant sur ce lien.

6. Droits de l’utilisateur

Conformément au RGPD et aux lois et réglementations applicables, vous disposez des droits suivants, sous réserve des périodes de conservation des données et des raisons légitimes :

  • Droit d’accès : aux Données traitées par Axle Energy concernant l’Utilisateur ;
  • Droit de rectification : si les Données sont inexactes ou incomplètes ;
  • Droit à l’effacement : permettre l’effacement des Données ;

  • Droit d’opposition (notamment au marketing direct) : au traitement de certaines Données ;
  • Droit à la portabilité (dans certains cas) : les Données sont transmises en vue d’une réutilisation éventuelle ;
  • Droit à l’information : il s’agit du droit d’obtenir des informations sur la manière dont Axle Energy traite les données ;
  • Droit de retirer votre consentement à tout moment.

Toute demande d'accès, de rectification ou d'opposition doit être accompagnée d'une copie d'un document prouvant l'identité de la personne qui fait la demande. Ces documents d'identité seront conservés pendant un (1) an pour l'exercice des droits d'accès et de rectification et trois (3) ans pour le droit d'opposition. Nous nous engageons à répondre à chaque demande dans les plus brefs délais, que les demandes puissent être satisfaites ou non, compte tenu de la situation et à la lumière des lois et règlements applicables.

Vous avez également le droit d’introduire une réclamation auprès d’une autorité de contrôle. En France, l’autorité compétente est la Commission nationale de l’informatique et des libertés (CNIL).

En France, vous pouvez également définir des directives relatives au sort de vos données après votre décès, conformément à la législation applicable.

7. Partage des Données

Nous partageons vos données uniquement lorsque cela est nécessaire et avec des garanties appropriées.

Dans le cadre du traitement des Données de l’utilisateur, nous pouvons transmettre ou donner accès à celles-ci aux catégories suivantes de sous-traitants de Données :

  • Prestataires techniques (hébergement, maintenance, support, outils de communication)
  • Prestataires de paiement
  • Partenaires de programmes (fournisseurs d’énergie, agrégateurs, gestionnaires de réseau, opérateurs de marché, constructeurs)
  • Conseils professionnels (juridiques, comptables)
  • Prestataires de services chargés de l'analyse marketing et de la segmentation des Utilisateurs
  • Fournisseur de la solution d’analyse statistique pour les cookies et les traceurs ;
  • Des prestataires de services pour le suivi et l'analyse de l'utilisation de notre Plateforme, pour faire de la publicité sur des sites web tiers auprès des Utilisateurs après qu'ils aient visité notre Application, pour le traitement des paiements, pour contacter les Utilisateurs.
  • Sociétés affiliées : Nous pouvons partager les informations de l'Utilisateur avec les affiliés d’Axle Energy, auquel cas nous exigerons de ces affiliés qu'ils respectent la présente politique de confidentialité. Les affiliés comprennent la société mère d’Axle Energy et toutes les autres filiales, associés de joint-ventures ou autres sociétés qu’Axle Energy contrôle ou qui sont sous contrôle commun avec Axle Energy ;
  • Partenaires commerciaux : Axle Energy peut partager les informations relatives aux Utilisateurs avec ses partenaires commerciaux afin d'offrir aux Utilisateurs certains produits, services ou promotions.
  • Autres parties : Avec le consentement de l'Utilisateur, Axle Energy peut divulguer des Données à toute autre fin à laquelle l'Utilisateur a consenti.
  • Autorités publiques lorsque la loi l’exige

Dans la mesure du possible, nous privilégions des données agrégées ou pseudonymisées.

Nous exigeons contractuellement que nos sous-traitants traitent les données uniquement selon nos instructions et respectent des obligations strictes de sécurité et de confidentialité.

Enfin, Axle Energy peut être amenée à communiquer ces Données à des tiers lorsque cette communication est requise par la loi, la réglementation ou une décision de justice, ou si cette communication est nécessaire pour assurer la protection et la défense de ses droits ou garantir la sécurité personnelle des Utilisateurs de l'Application ou du public.

En dehors de ces cas, les Données des Utilisateurs ne seront pas cédées ou rendues accessibles à un tiers, sous réserve de toute restructuration d’Axle Energy, y compris l'apport total ou partiel d'actifs, la fusion, l'absorption, l'acquisition, la scission et plus généralement toute opération de réorganisation.

8. Transferts Internationaux

Les informations de l'Utilisateur, y compris les Données de l'Utilisateur, sont traitées dans les bureaux d’Axle Energy ou de ses sous-traitants et dans tout autre lieu où se trouvent les parties impliquées dans le traitement. Par conséquent, ces informations peuvent être transférées et conservées sur des ordinateurs situés en dehors de l'État, de la province, du pays ou de toute autre juridiction gouvernementale de l'Utilisateur, où les lois sur la protection des données peuvent différer de celles de la juridiction de l'Utilisateur.

Le consentement de l'Utilisateur à la présente politique de protection de la vie privée, suivi de la transmission de ces informations par l'Utilisateur, représente l'accord de l'Utilisateur à ce transfert.

Axle Energy ou ses sous-traitants prendront toutes les mesures raisonnablement nécessaires pour s'assurer que les Données de l'Utilisateur sont traitées en toute sécurité et conformément à la présente politique de confidentialité et aucun transfert de Données de l'Utilisateur n'aura lieu vers une organisation ou un pays à moins que des contrôles adéquats ne soient mis en place, y compris la sécurité des Données et autres informations personnelles.

Vos données peuvent être traitées au Royaume-Uni et dans d’autres pays. Les transferts depuis l’EEE vers le Royaume-Uni peuvent s’appuyer sur une décision d’adéquation de la Commission européenne en vigueur.

Lorsque des données sont transférées vers des pays ne bénéficiant pas d’une décision d’adéquation, nous mettons en place des garanties appropriées (ex. clauses contractuelles types) et, si nécessaire, des mesures complémentaires.

9. Durée de Conservation

Nous conservons vos données uniquement pendant la durée nécessaire aux finalités décrites, puis nous les supprimons ou les anonymisons, sauf obligation légale ou nécessité de défense en justice.

À titre indicatif :

  • Données de compte : pendant la durée d’utilisation du Service, puis suppression ou archivage limité à cinq (5) ans.
  • Données liées à un programme de flexibilité : pendant la durée du programme, puis conservation limitée pour la preuve et la conformité à une durée de cinq (5) ans.
  • Données de prospection commerciale : en principe jusqu’à trois (3) ans à compter du dernier contact ou de la fin de la relation, sauf opposition.
  • Données comptables et facturation : conservées conformément aux obligations légales applicables, notamment l’article L. 123-22 du Code de commerce (dix (10) ans).
  • Choix relatifs aux cookies : Les cookies non essentiels (notamment les cookies analytiques et fonctionnels) sont conservés pour une durée maximale de 28 jours. Les cookies strictement nécessaires au fonctionnement du site peuvent être conservés pendant la durée nécessaire à la fourniture du service demandé.

10. Candidats à l’Emploi

Dans le cadre d’une candidature, nous traitons vos données afin d’évaluer votre profil et gérer le processus de recrutement. Les candidatures non retenues sont conservées pendant deux (2) ans après la clôture du poste, sauf accord différent.

11. Recherche Utilisateur

Nous pouvons mener des études utilisateurs afin d’améliorer le Service. Les données collectées sont utilisées uniquement à des fins de recherche et ne sont pas vendues.

Les enregistrements sont supprimés lorsqu’ils ne sont plus nécessaires et au plus tard après trois (3) ans. Les transcriptions peuvent être conservées sous forme anonymisée.

12. Droit de déposer une plainte

Les Utilisateurs ont également le droit de déposer une plainte auprès de leur autorité locale de protection des Données. Pour la France en particulier, l'Utilisateur a également le droit d'introduire une réclamation auprès de la Commission Nationale de l'Informatique et des Libertés (CNIL), 3 place de Fontenoy - TSA 80715 - 75334 Paris Cedex 07, sur la manière dont Axle Energy collecte et traite les Données.
